آئینی دستاویز
Consitutional Document
عربی
هذا کتاب من محمد النبی (رسول اﷲ) صلی الله علیه وآله وسلم.

This is a constitutional document given by Muhammad (SAW), the Prophet,
(Messenger of God).
اردو
یہ اللہ کے نبی اور رسول محمد صلی اللہ علیہ وآلہ وسلم کی طرف سے دستوری تحریر (دستاویز ) ہے۔
آرٹیکل نمبر 2
ریاست کے آئینی طبقات
Constitutional Subjects of the State
عربی
بين المؤمنين والمسلمين من قريش و (أهل) يثرب و من تبعهم فلحق بهم وجاهد معهم.
انگلش
(This shall be a pact) between the Muslims of Quraysh, the people of Yathrib
(the Citizens of Madina) and those who shall follow them and become attached to
them (politically) and fight along with them. (All these communities shall be
the constitutional subjects of the State.)
اردو
یہ معاہدہ مسلمانان قریش اور اہل یثرب اور ان لوگوں کے مابين ہے جو ان کے تابع ہوں
اور ان کے ساته شامل ہوجائیں اور ان کے ہمراہ جنگ میں حصہ لیں۔ (یہ سب گروہ ریاست
مدینہ کے آئینی طبقات متصور ہوں گے)۔

آئینی قومیت کی تشکیل
Formation of the Constitutional
Nationality
عربی
أنهم أمة واحدة من دون الناس.
انگلش
The aforementioned communities shall formulate a Constitutional Unity as
distinct from (other) people.
اردو
تمام (دنیا کے دیگر ) لوگوں کے بالمقابل ان کی ایک علیحدہ سیاسی وحدت (قومیت) ہوگی۔
آرٹیکل نمبر 4
مہاجرین قریش کے لئے سابقہ قبائلی قانونِ دیّات کی توثیق و نفاذ
Validation and Enforcement of the Former Tribal Laws of Blood Money for the
Emigrant Quraysh.
عربی
المهاجرون من قريش علي ربعتهم يتعاقلون بينهم معاقلهم الأولي، وهم يفدون عانيهم
بالمعروف والقسط بين المؤمنين.
انگلش
The emigrants from Quraysh shall be responsible for their ward and they shall,
according to their former approved practice, jointly pay the blood money in
mutual collaboration and every group shall secure the release of their prisoners
by paying the ransom. Moreover, the deal among the believers shall be in
accordance with the recognised principles of law and justice.
اردو
قریش میں سے ہجرت کر کے آنے والے اپنے محلے پر ( ذمہ دار ) ہوں گے اور اپنے خوں بہا
باہم مل کر دیا کریں گے اور اپنے ہاں کے قیدی کو خود فدیہ دے کر چھڑائیں گے، مزید
یہ کہ ایمان والوں کا باہمی برتاؤ نیکی اور انصاف پر مبنی ہوگا۔
آرٹیکل نمبر 5
بنو عوف کے لئے ان کے قبائلی قانونِ دیّات کی توثیق
Validation of the Former Laws of Blood Money for Banu Auf
عربی
و بنو عوف علی ربعتهم يتعاقلون معاقلهم الأولي وکل طائفة تفدي عانيها بالمعروف
والقسط بين المؤمنين.

And the emigrants from Banu Auf shall be responsible for their ward and they
shall, according to their former approved practice, jointly pay the blood money
in mutual collaboration and every group shall secure the release of their
prisoners by paying the ransom. Moreover, the deal among the believers shall be

اور بنی عوف اپنے محلے پر (ذمہ دار) ہوں گے اور حسب سابق اپنے خوں بہا باہم مل کر

عربی
و بنو حارث (بن الخزرج) علی ربعتهم يتعاقلون معاقلهم الأولي وکل طائفة تفدي
عانيها بالمعروف والقسط بين المؤمنين.

And the emigrants from Banu Harith shall be responsible for their ward and they
shall, according to their former approved practice, jointly pay the blood money

عربی
و بنو النجار علی ربعتهم يتعاقلون معاقلهم الأولی و کل طائفة تفدی عانيها بالمعروف

و بنو عمرو بن عوف علی ربعتهم يتعاقلون معاقلهم الأولی وکل طائفة تفدی عانيها
بالمعروف والقسط بين المؤمنين.

عربی
و بنو الأوس علی ربعتهم يتعاقلون معاقلهم الأولی و کل طائفة تفدی عانيها بالمعروف
والقسط بين المؤمنين.

shall, according to their former approved practice, jointly pay the blood money

آرٹیکل نمبر 13
تمام طبقات کے لئے بلا امتیاز پابندی قانون و عدل کا حکم
Indiscriminate Rule of Law and Justice for all the Communities.
عربی
و کل طائفة تفدی عانيها بالمعروف و القسط بين المؤمنين.
انگلش
And every group shall secure the release of its captives ensuring that an
indiscriminate rule of law and justice is applied among the believers.
اردو
ہر گروہ اپنے قیدیوں کا زرِ فدیہ ادا کر کے انہیں رہائی دلائے گا اور اس ضمن میں
مسلمانوں کے درمیان قانون و انصاف کے بلا امتیاز اطلاق کو یقینی بنائے گا۔
آرٹیکل نمبر14
تنفیذ قانون میں تخفیف کی ممانعت
Prohibition of Relaxation in Execution of Law
عربی
و ان المؤمنين لا يترکون مفرحا بينهم أن يعطوه بالمعروف فی فداء او عقل.
انگلش
The believers shall not leave a debtor among them, but shall help him in paying
his ransom, according to what shall be considered fair.
اردو
اور ایمان والے کسی قرض کے بوجہ سے دبے ہوئے کو مدد کئے بغیر نہیں چھوڑیں گے، جن کے
ذمہ زرِ فدیہ یا دیت ہے۔
آرٹیکل نمبر15
کسی کی ناحق حمایت کی ممانعت
Prohibition of Unjust Favouritism
عربی
و أن لا يحالف مؤمن مولی مؤمن دونه.
انگلش
A believer shall not form an alliance with the associate of (another) believer
without the (latter's) consent.
اردو
اور یہ کہ کوئی مومن کسی دوسرے مومن کے مولا (معاہداتی بھائی) سے اس کی مرضی کے
بغیر معاہدہ نہیں کرے گا۔
آرٹیکل نمبر16
ظلم، گناہ اور فساد کے خلاف اجتماعی مزاحمت
Collective Resistance against Unjustice, Tyranny and Mischief
عربی
و أن المؤمنين المتقين أيديهم علي کل من بغي منهم أو ابتغي دسيعة ظلم أو إثما
أو عدوانا أو فسادا بين المؤمنين و أن أيديهم عليه جميعا ولو کان ولد أحدهم.
انگلش
There shall be collective resistance by the believers against any individual who
rises in rebellion, attempts to acquire anything by force, violates any pledge
or attempts to spread mischief amongst the believers. Such collective resistance
against the perpetrator shall occur even if he is the son of anyone of them.
اردو
اور متقی ایمان والوں کے ہاتھ ان میں سے ہر اس شخص کے خلاف اٹھیں گے جو سرکشی کرے
یا استحصال بالجبر کرنا چاہے یا گناہ یا تعدی کا ارتکاب کرے، یا پر امن شہریوں
(مومنوں) میں فساد پھیلانا چاہے اور ایسے شخص کے خلاف سب مل کر اٹھیں گے، خواہ وہ
ان میں سے کسی کا بیٹا ہی کیوں نہ ہو۔
آرٹیکل نمبر17
مسلمان کو مسلمان کے قتل کی ممانعت
Prohibition of Killing of a Muslim by a Muslim
عربی
ولا يقتل مؤمن مومنا فی کافر، ولا ينصر کافرا علی مؤمن.
انگلش
A believer shall not kill (another) believer (in retaliation) for an unbeliever,
nor help an unbeliever against a believer.
اردو
اور کوئی ایمان والا کسی ایمان والے کو کسی کافر کے بدلے قتل نہیں کرے گا، اور نہ
کسی کافر کی کسی ایمان والے کے خلاف مدد کرے گا۔
آرٹیکل نمبر18
مسلمانوں کی جانی حفاظت کے مساوی حق کی ضمانت
Guarantee of Equal Right of Life Protection for all the Muslims
عربی
و أن ذمة اﷲ واحدة يجير عليهم أدناهم.
انگلش
The security of God (granted under this constitution) is one. This protection
can be granted even by the humblest of the believers (that would be equally
binding for all).
اردو
اور اللہ کا ذمہ ایک ہی ہے۔ ان (مسلمانوں) کا ادنیٰ ترین فرد بھی کسی کو پناہ دے کر
سب پر پابندی عائد کرسکے گا۔
آرٹیکل نمبر19
دیگر آئینی طبقات کے مقابل امت مسلمہ کا الگ تشخص
Distinctive Identity of the Muslims Against other Constitutional Communities
عربی
و أن المؤمنين بعضهم موالی بعض دون الناس.
انگلش
The believers shall be the associates of one another against all other people
(of the world).
اردو
اور ایمان والے بقیہ لوگوں کے مقابلباہم بھائی بھائی ہیں۔
آرٹیکل نمبر20
غیر مسلم اقلیتوں (یہود) کی جانی حفاظت کا حق بھی (مسلمانوں کے) برابر ہے
Non-Muslim Minorities (Jews) have the same Right of Life Protection (like
Muslims)
عربی
و أنه من تبعنا من يهود فإن له النصر والأ سوة غير مظلومين ولا متناصر عليهم.
انگلش
A Jew, who obeys us (the state) shall enjoy the same right of life protection
(as the believers do), so long as they (the believers) are not wronged by him (
the Jew), and he does not help (others) against them.
اردو
اور یہودیوں میں سے جو ہماری (ریاست مدینہ کی)اتباع کرے گا اسے مدد اور مساوات حاصل
ہوگی، جب تک وہ اہل ایمان پر ظلم کا مرتکب نہ ہو یا ان کے خلاف (کسی مخالف کی) مدد
نہ کرے۔
آرٹیکل نمبر21
تمام مسلمانوں کیلئے عدل اور برابری پر مبنی یکساں امن و امان کی ضمانت
Guarantee of Peace and Security for all the Muslims based on Equality and
Justice
عربی
و ان سلم المومنين واحدة لا يسالم مومن دون مومن في قتال في سبيل اﷲ الا علي سواء و
عدل بينهم.
انگلش
And verily the peace granted by the believers shall be one. If there is any war
in the way of Allah, no believer shall make any treaty of peace (with the enemy)
apart from other believers, unless that is based on equality and fairness among
all.
اردو
اور ایمان والوں کی صلح (معاہدہ امن) ایک ہی ہوگی۔ اللہ کی راہ میں لڑائی کے دوران
کوئی ایمان والا کسی دوسرے ایمان والے کو چھوڑ کر (دشمن سے ) صلح نہیں کرے گا۔ جب
تک کہ (یہ صلح) ان سب کیلئے برابر اور یکساں نہ ہو۔
آرٹیکل نمبر22
جنگی معاونین کی امداد کا قانون
Law of Relief for War Allies
عربی
و أن کل غازية غزت معنا يعقب بعضها بعضا.
انگلش
Every war ally of ours shall receive relief turns (at riding) at all military
duties.
اردو
اور ان تمام گروہوں کو جو ہمارے ہمراہ (دشمن کے خلاف) جنگ کریں باہم نوبت بہ نوبت
رخصت دلائی جائے گی۔
آرٹیکل نمبر23
مسلمانوں کے لئے ایک دوسرے کی خاطر
جنگی انتقام لینے کا قانون
Law of Vengeance for the Muslims in case of Bloodshed in the way of Allah
عربی
و أن المؤمنين يبيئ بعضهم عن بعض بما نال دماء هم في سبيل اﷲ.
انگلش
The believers shall execute vengeance for one another for the bloodshed in the
way of Allah.
اردو
اور ایمان والے راہ خدا میں اپنی ہونے والی خونریزی کا ایک دوسرے کے لئے (دشمن سے)
انتقام لیں گے۔
آرٹیکل نمبر24
اسلام ہی بہترین نظام حیات ہے
Islam is the Best Code of life
عربی
و أن المؤمنين المتقين علی أحسن هدي و أقومه.
انگلش
All the God-fearing believers are under the best and most correct guidance of
Islam.
اردو
اور بلا شبہ ایمان اور تقوی والے سب سے اچھے اور سیدھے راستے پر ہیں۔
آرٹیکل نمبر25
دشمن کوجان و مال کا تحفظ فراہم کرنے کی ممانعت
Prohibition of Providing Security of Life and Property to the Enemy
عربی
و أنه لا يجير مشرک مالاً لقريش و لا نفساً و لا يحول دونه
علی مؤمن.
انگلش
No idolater (or any non-believer among the clans of Madina) shall give
protection for property and life to (any of the) Quraysh (because of their being
hostile to the state of Madina) nor shall intervene on his behalf against any
believer.
اردو
اور ( مدینہ کی غیر مسلم رعیت میں سے) کوئی مشرک قریش کی جان و مال کو کوئی پناہ دے
گا اور نہ ان کی خاطر کسی مومن کے آڑے آئے گا۔
آرٹیکل نمبر26
مسلمانوں کے قتل کیلئے قانون قصاص کا اجرا
Execution of the Law of Retaliation for a Muslim Murder
عربی
و أنه من اعتبط مؤمناً قتلا عن بينة فإنه قود به، إلا أن يرضی ولی المقتول
(بالعقل)، و أنّ المؤمنين عليه کافّة و لا يحل لهم إلاقيام عليه.
انگلش
When anyone intentionally kills a believer, the evidence being clear he shall be
killed in retaliation, unless the heirs of the victim are satisfied with the
bloodmoney. All the believers shall solidly stand against the murderer and
nothing will be lawful for them except opposing him.
اردو
اور جو شخص کسی مومن کو عمداً قتل کرے اور ثبوت پیش ہو تو اس سے قصاص لیا جائے گا،
بجز اس کے کہ مقتول کا ولی خوں بہا پر راضی ہوجائے۔ اور تمام ایمان والے اس (قصاص)
کی تعمیل کیلئے اٹھیں گے اور اس کے سوا انہیں کوئی اور چیز جائز نہ ہوگی۔
آرٹیکل نمبر27
معاہدہ کی خلاف ورزی میں فتنہ پروری اور فساد انگیزی کرنے والے کیلئے کوئی حفاظت
اور رعایت نہیں
No Protection or Concession for the Doer of Mischief and Subversion against the
Constitution
عربی
و أنه لا هحل لمؤمن أقرّا بما فه هذه الصحهفة، وآمن باﷲ والهوم الآخر أن هنصر محدثا
أو هؤوهه، و أن من نصره، أو آواه، فإن علهه لعنة اﷲ و غضبه هوم القهامة،
ولا هؤخذ منه صرف ولا عدل.

A believer who believes in God and in the Hereafter and agrees to the contents
of this document shall not provide any protection or concession to those who
engage in mischief and subversion against this Constitution. Those who do so
shall face the curse and wrath of God on the Day of Resurrection. Furthermore,
nothing shall be accepted from them as a compensation or restitution (in the
life hereafter).
اردو
اور کسی ایسے ایمان والے کیلئے جو اس دستور العمل (صحیفہ) کے مندرجات (کی تعمیل) کا
اقرار کرچکا ہو اور خدا اور یوم آخرت پر ایمان لا چکا ہو، یہ بات جائز نہ ہوگی کہ
کسی قاتل کو مدد یا پناہ دے اور جو اسے مدد یا پناہ دے گا تو قیامت کے دن اس پر خدا
کی لعنت اور غضب نازل ہو گا اور اس سے کوئی رقم یا معاوضہ قبول نہیں کیا جائے گا۔
آرٹیکل نمبر28
جملہ نزاعات میں آخری اور حتمی حکم اللہ تعالیٰ اور
حضرت محمد صلی اللہ علیہ وآلہ وسلم کا ہوگا۔
The Final and Absolute Authority in the Disputes vests in Almighty Allah and
Hadrat Muhammad (SAW)
عربی
و أنکم مما اختلفتم فيه من شئ، فإن مرده إلی اﷲ و إلی
محمد.
انگلش
When anyone among you differs about anything, the dispute shall be referred to
Almighty Allah and to the Prophet Muhammad (SAW) (as all final and absolute
authority is vested in them).
اردو
اور جب کبھی تم میں کسی چیز کے متعلق اختلاف ہو تو اسے اللہ اور محمد صلی اللہ علیہ
وآلہ وسلم کی طرف
لوٹایا جائے گا۔ (کیونکہ آخری اور حتمی حکم اللہ اور اس کے رسول محمد صلی اللہ علیہ
وآلہ وسلم ہی ہے)۔
آرٹیکل نمبر29
یہود کی جنگی اخراجات میں متناسب ذمہ داری
Proportionate Liability of Non-Muslim Citizens (the Jews) in Bearing the
War Expenses
عربی
و أن اليهود ينفقون مع المؤمنين ما د اموا محاربين.
انگلش
The Jews (non-Muslim minorities) will be subjected to a proportionate liability
of the war expenses along with the believers so long as they (the Jews) continue
to fight in conjunction with them.
اردو
اور یہودی اس وقت تک مومنین کے ساتھ (جنگی) اخراجات برداشت کرتے رہیں گے جب تک وہ
مل کر جنگ کرتے ر ہیں۔
